Ludika VTT respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

We take copyright infringement seriously and will respond promptly to valid DMCA notices. We also respect the rights of users who believe their content was removed in error.

1. Our Commitment to Copyright Protection

Ludika VTT is a platform that allows users to upload and share game content for virtual tabletop gaming. While we provide the tools and infrastructure, users are responsible for ensuring they have the legal right to upload and share any content on our platform.

We comply with the provisions of the Digital Millennium Copyright Act (17 U.S.C. § 512) and will:

  • Respond promptly to valid DMCA takedown notices
  • Remove or disable access to allegedly infringing material
  • Notify users when their content is removed due to a DMCA claim
  • Process counter-notifications in accordance with DMCA procedures
  • Terminate accounts of repeat infringers

2. Filing a DMCA Takedown Notice

If you are a copyright owner (or authorized to act on behalf of one) and believe that content on Ludika VTT infringes your copyright, you may submit a DMCA takedown notice to our designated Copyright Agent.

Required Information

Your DMCA notice must include the following information to be valid:

  1. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, provide a representative list.
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing, including specific URLs or other information reasonably sufficient to locate the material on Ludika VTT (e.g., game table ID, uploaded file name, screenshot).
  4. Contact Information: Your contact information, including your name, mailing address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

⚠️ Important Notice

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages. Please ensure your claim is accurate and made in good faith.

3. Our Response to DMCA Notices

Upon receiving a valid DMCA takedown notice, we will:

  1. Review the notice to ensure it meets DMCA requirements
  2. Remove or disable access to the allegedly infringing material
  3. Notify the user who uploaded the content that it has been removed
  4. Provide the user with a copy of the DMCA notice (with your contact information)
  5. Document the takedown for our records

We typically process valid DMCA notices within 1-3 business days. If the notice is incomplete or unclear, we may contact you for additional information before taking action.

4. Filing a DMCA Counter-Notification

If you believe that content you uploaded was removed in error or that you have the legal right to use the material, you may file a DMCA counter-notification.

Required Information

Your counter-notification must include:

  1. Signature: Your physical or electronic signature.
  2. Identification of Removed Material: Identification of the material that has been removed or disabled and the location where it appeared before removal (e.g., game table ID, file name).
  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Contact Information: Your name, address, telephone number, and email address.
  5. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, any judicial district in which Ludika VTT may be found), and that you will accept service of process from the person who filed the original DMCA notice or their agent.

Counter-Notification Process

After receiving a valid counter-notification:

  1. We will forward a copy to the original complainant
  2. We will inform them that we will restore the content in 10-14 business days
  3. If the complainant does not file a court action seeking an injunction, we will restore the content
  4. If a court order is received, we will comply with the court's decision

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Ludika VTT has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

What constitutes a repeat infringer: A user who has received two or more valid DMCA takedown notices and has not successfully filed counter-notifications, or whose counter-notifications were rejected, may be considered a repeat infringer.

6. User Responsibilities

As a Ludika VTT user, you are responsible for:

  • Ensuring you have the legal right to upload and share any content on the platform
  • Obtaining necessary permissions from copyright holders before uploading their work
  • Understanding fair use principles and ensuring your use qualifies (if applicable)
  • Respecting the intellectual property rights of game publishers, artists, and other creators
  • Not uploading pirated or unauthorized copies of commercial games

Best Practice: When in doubt about whether you have the right to upload content, seek permission from the copyright holder or consult with a legal professional.

7. Fair Use Considerations

While we respect copyright law, we also recognize that fair use is an important part of copyright law. Fair use allows limited use of copyrighted material without permission for purposes such as criticism, comment, news reporting, teaching, scholarship, or research.

However, fair use is determined on a case-by-case basis and depends on factors including:

  • The purpose and character of the use (commercial vs. educational)
  • The nature of the copyrighted work
  • The amount and substantiality of the portion used
  • The effect of the use on the potential market for the original work

If you believe your use of copyrighted material constitutes fair use, you should include this information in your counter-notification if your content is removed.

8. Limitations and Disclaimers

Ludika VTT acts as a service provider and does not actively monitor user-uploaded content for copyright infringement. We rely on copyright holders to notify us of infringement through the DMCA process.

We do not:

  • Pre-screen user content for copyright compliance
  • Verify the validity of DMCA notices (beyond checking for required elements)
  • Determine whether content constitutes fair use
  • Provide legal advice regarding copyright matters
  • Mediate disputes between copyright holders and users

All copyright disputes should be resolved between the parties involved. We recommend consulting with legal counsel if you have questions about copyright law or your rights.
